Chapter 12 · Penalties
Alcohol, Drugs, and DUI
0.08 BAC, zero tolerance under 21, implied consent, and Oklahoma penalties.
Impairment starts before the limit
Alcohol slows judgment, vision, and reaction time long before you “feel drunk.” There is no safe way to drive after drinking. Coffee, cold air, and a shower do not sober you up — only time does.
Legal limits
It is illegal to drive, operate, or be in actual physical control of a vehicle with a BAC of 0.08% or higher, while under the influence of alcohol, or with any amount of a Schedule I drug in your system. Commercial drivers are held to 0.04%. Oklahoma also allows a DWI charge around 0.05–0.08% when other signs of impairment are present. Aggravated DUI begins at 0.15%.
Drivers under 21 are under zero tolerance: any measurable alcohol can be charged. Under 18 faces additional license consequences.

Implied consent
By driving in Oklahoma you have already consented to a breath or blood test if an officer arrests you for DUI. Refusing the chemical test triggers an administrative license action even if you are later found not guilty in court. A first refusal commonly brings a 180-day revocation plus ignition-interlock requirements. You may refuse field sobriety tests; the chemical test is the one implied consent covers.
